Tax Audit Deadline Extended to 21 October 2026; ITR Due Date for Audit Cases Now 21 November

The Central Board of Direct Taxes (CBDT) on 28 September 2026 extended the due date for filing tax audit reports for assessment year 2026-27 from 30 September to 21 October 2026, and the income tax return deadline for these audit cases from 31 October to 21 November 2026. The tax audit deadline extended announcement came in a press release two days before the original date, and the formal order was to be issued separately. CNBC-TV18, the Times of India and professional sites including CAclubindia reported the same dates. As of 29 September evening, we had not seen the formal notification on the department’s website.

The relief applies to taxpayers listed at serial number 2 of the table below Explanation 2 to section 139(1) of the Income-tax Act, 1961. These are mainly businesses and professionals whose accounts must be audited, companies, and working partners of audited firms. Since AY 2026-27 relates to financial year 2025-26, the 1961 Act still governs these returns, even though the Income-tax Act, 2025 took effect on 1 April 2026.

Tax audit report due date and the one-month gap

The tax audit report due date is linked by law to the return deadline. Section 44AB requires the report to be furnished one month before the due date of the return, which is why moving the ITR date to 21 November automatically pulls the audit report to 21 October. CBDT’s release extends both together, keeping that one-month gap intact.

For auditors, having the tax audit deadline extended by three weeks matters. Sumeet Hemkar of Deloitte told CNBC-TV18 that reconciliations and disruptions from the festival season and banking holidays had made the 30 September date hard to meet.

ITR due date for audit cases, and who is not covered

The new ITR due date for audit cases is 21 November 2026. Several groups are unaffected:

  • Salaried individuals and others not requiring audit, whose due date for AY 2026-27 has already passed; belated or revised returns follow their own deadlines.
  • Taxpayers with international or specified domestic transactions who must file a transfer pricing report in Form 3CEB. Reports say their dates have not changed.

What about interest under section 234A?

Past extensions have sometimes come with a condition that interest for late filing still applies where the self-assessment tax exceeds a threshold. The press release did not spell out any such condition, as far as the reported text shows. Wait for the formal order on the Income Tax Department’s website before assuming full interest relief.

What should taxpayers and auditors do now?

Uploading the audit report on the e-filing portal still involves two steps: the auditor files Form 3CA or 3CB with 3CD, and the taxpayer must accept it from their own login. Many reports sit unaccepted for days, which counts as not filed. With the tax audit deadline extended, the sensible plan is to finish uploads by mid-October and keep the last week for acceptance and portal glitches.

Even with the tax audit deadline extended, late filing of the audit report can attract a penalty of 0.5% of turnover or gross receipts, up to ₹1.5 lakh, under section 271B, unless there is reasonable cause. Missing the return date brings a late fee and interest.

Advance tax is a separate matter. The third instalment remains due on 15 December and is unaffected.
